Can Universal Credit Be Backdated? Rules and How to Request It

Yes, Universal Credit can be backdated by up to one month, but only in specific circumstances. It is not automatic and it is not available to everyone. You have to show the DWP that you had a genuine reason for not claiming earlier and that it was not reasonable to expect you to claim on time.

Under the Universal Credit (Claims and Payments) Regulations 2013, your claim normally starts on the day you submit your digital application. Backdating extends that start date back by up to 30 calendar days.

When Can Universal Credit Be Backdated?

The DWP accepts backdating requests under a limited set of circumstances. You must fall into at least one of these categories:

  • You were unwell and a health condition prevented you from making a claim. Medical evidence will be required.
  • The DWP or Universal Credit system experienced a technical failure on the day you tried to claim, and you applied on the first available day after the failure.

How to Request Backdating

The Universal Credit online claim form does not ask whether you want backdating. You need to raise it yourself.

The most reliable way is to write a message in your UC journal when you make your claim stating that you believe you are entitled to backdating and explaining your reason. If your claim has already been decided and backdating was not considered, you can request a mandatory reconsideration and ask for the start date to be reviewed.

A 2024 Court of Appeal ruling confirmed that you do not need to request backdating at the time of making your original claim for it to be considered later. If you realise after your claim has been processed that you may have been eligible for backdating, you can request a revision of the decision.
